COMMERCIAL POLICY
Buti sas products are offered for sale on the torrettabuti.it website.

The Seller carries out its e-commerce activity exclusively towards its end users who have reached the age of majority and who are "consumers". A consumer is any natural person who acts for purposes not related to his or her commercial, entrepreneurial or professional activity, if any.

In consideration of its commercial policy, the Seller reserves the right not to accept purchase order proposals from persons other than the “consumer” or in any case purchase order proposals that do not comply with its commercial policy, such as, for example, order proposals for which there is a report, or suspicion, of fraudulent or illegal activity. In such cases, the Seller will inform the user of the non-acceptance of the order proposal.

All order proposals sent to the Seller and returns made by users must also correspond to normal consumption needs. The Seller therefore monitors the number of order proposals sent and returns made.

CONCLUSION OF THE CONTRACT AND DELIVERY OF THE PRODUCTS
Every order placed on shop.butipelletterie.com implies the conclusion of a sales contract in Italian. Since the order is for a Torretta Buti product, a contract is concluded between the buyer and the Buti sas company.

By clicking on the “add to cart” button, the customer places an order for the selected item that will be transferred to the virtual cart. The order is considered to be placed and binding only when it is confirmed by clicking on the “proceed with checkout” button and completing the payment procedure by entering all the data required for shipping. Once the order has been sent, Buti will send an order confirmation email as soon as possible. The sales contract is considered to be concluded between Buti and the customer when the latter receives the order confirmation. If the customer does not receive any order confirmation as indicated in this paragraph, the relevant order must be considered rejected by Buti and, therefore, void.

The Seller may not accept purchase order proposals that do not provide sufficient guarantees of solvency or that are incomplete or incorrect or in the event of unavailability of the products. Where the products in the order are not available for reasons beyond the control of Torretta Buti, the latter will promptly notify the customer. In this case, Buti will have no obligation to deliver the goods ordered. In any case, where the products ordered are not available, Buti will promptly refund the customer any sums already paid.

It is understood that with the electronic transmission of the order proposal, the buyer unconditionally accepts and undertakes to observe, in relations with the Seller, these General Conditions of Sale. 

PRICES
The price of the product is indicated in the product sheet. However, product prices may be subject to updates. It is therefore advisable to check the final sale price before submitting the relevant order proposal and check the price of the product at the time of checkout. In the event that a recognisable error is found in the indication - by Buti Sas - of the price of a product or in the calculation of the amount requested in payment, Buti will not accept the order proposal and will contact the user in order to offer the opportunity to transmit the purchase order proposal for the product(s) at the correct price. The prices indicated on the site are to be considered inclusive of taxes and duties foreseen in the country of invoicing.

APPLICABLE LAW
Without prejudice to the application of mandatory European consumer protection provisions, the General Conditions of Sale are governed by Italian law and in particular by the Consumer Code and Legislative Decree 9 April 2003, no. 70 (“Implementation of Directive 2000/31/EC on certain legal aspects of information society services in the internal market, with particular reference to electronic commerce”).

In the event of disputes between the Seller and each end user, arising from the General Conditions of Sale, the Seller guarantees, from now on, full adhesion and acceptance of the RisolviOnline conciliation service. RisolviOnline is an independent and institutional service, provided by the Arbitration Chamber of the Chamber of Commerce of Milan, which allows you to reach a satisfactory agreement, with the help of a neutral and competent conciliator, on the Internet. For all disputes relating to the purchase and/or to these General Conditions of Sale, the Court of the place of domicile or residence of the consumer will have jurisdiction in accordance with the applicable law or, at the consumer's choice, the Court of Pisa.

MODIFICATION AND UPDATE
The General Conditions of Sale are modified from time to time by the Seller also in consideration of any regulatory changes. The new General Conditions of Sale will be effective from the date of publication on torrettabuti.it.
